Due to the public health emergency posed by COVID-19, CMS has extended the implementation timeline for the ADT notification Conditions of Participation (CoP), one component of the Interoperability and Patient Access final rule, by an additional six months. Initially, the final rule – displayed on the CMS website on March 9, 2020 – stated that the ADT notification CoP would be effective six months after it is published in the Federal Register. However, CMS’s latest announcement has confirmed that this component of the final rule will now be effective May 1, 2021 – 12 months following its publication in the Federal Register.
Though COVID-19 has made evident – more than ever before – the critical importance of interoperability, hospitals are on the front lines of this pandemic and understandably require additional flexibility to ensure compliance with these new mandates. Even with an extended implementation timeline for the ADT notification CoP, hospitals must still have policies and procedures in place by spring 2021. It is in hospitals’ best interests to prioritize interoperability once they have the capacity to do so.
